Our Services
Disappointing plaintiffs’ attorneys everywhere.
In good economies and bad, financial services litigation is a fact of life. From interest rate challenges to national class action lawsuits, we have the experience and skill to resolve cases efficiently and with sensitivity to the difficult circumstances that often surround consumer litigation.
Litigation
We litigate claims involving consumer fraud and deceptive business practices, wrongful foreclosure, debt collection activities, predatory or discriminatory lending allegations, lien priority disputes, check processing, and loan repurchase demands.
Class Action Defense
In defending against class action lawsuits, we provide a comprehensive level of service, from advising on public relations issues to negotiating class-wide settlements to handling appeals of class certification rulings and objector’s claims and challenges.
Contested Foreclosures
We represent mortgage originators, servicers and assignees in individual borrower challenges involving a variety of claims, such as lack of standing to foreclose, counterclaims for improper escrow practices, force-placed insurance claims, breach of fiduciary duty, and federal and state statutory violations.
Bankruptcy Litigation
We represent creditors in adversary proceedings, including lien priority litigation, fraudulent transfer litigation, preference litigation, and other avoidance actions in which debtors file claims under TILA, RESPA and wrongful foreclosure.
Alternative Dispute Resolution
We counsel clients on the rights and obligations of ADR provisions in their consumer credit contracts, and we assist them in determining at the outset of a case the relative merits of resolving a dispute in front of an arbitration panel or in front of a judge and jury.
