The Nuts and Bolts of Arbitration

Event Highlights:
Arbitration clauses, especially when they contain class action waivers, can be an extremely effective device in limiting liability and legal expenses. But arbitration is not all that it’s cracked up to be, and is not necessarily available to downstream debt owners and collectors even when a credit agreement comes with an arbitration provision. This panel will address the pros and cons of arbitration, whether to incorporate arbitration into existing agreements, the mechanics of motions to compel, and the common (and some uncommon) defenses to arbitration.
