The Nuts and Bolts of Arbitration
Location: Westin Michigan Avenue,
909 N. Michigan Avenue, Chicago, IL
Date: November 8, 2012
Katrina Christakis and Raechelle Delarmente Norman discuss the benefits and mechanics of arbitration, including the ability of downstream debt owners to enforce arbitration clauses and the growing political opposition to consumer arbitration agreements, at ACA International’s 2012 Fall Forum and Expo in Chicago.
Arbitration clauses, especially when they contain class action waivers, can be an extremely effective device in limiting liability and legal expenses. But arbitration is not all that it’s cracked up to be, and is not necessarily available to downstream debt owners and collectors even when a credit agreement comes with an arbitration provision. This panel will address the pros and cons of arbitration, whether to incorporate arbitration into existing agreements, the mechanics of motions to compel, and the common (and some uncommon) defenses to arbitration.
